Learned counsel for the caveator-respondent is present. He states that he has not been served the copy of the petition.
Present petition has been filed challenging the judgment and order of the trial court passed in SCC case and as such present petition under Article 227 of the Constitution of India is not maintainable as the petitioner has alternative statuary remedy by way of filing SCC revision.
Accordingly, present petition stands dismissed on the ground of alternative remedy. However, the petitioner is at liberty to avail remedy as may be available to him in accordance with law.
When the revision is filed, learned counsel for the petitioner is directed to serve a copy on Sri Ashish Kumar Singh, learned counsel for the caveator, who has filed caveat application.
Office is directed to return the certified copy to the learned counsel for the petitioner within three days after keeping photocopy of the same.
