Heard learned counsel for the review-applicant.
This is a review application of the judgment dated 14th February, 2020 rendered by a Division Bench of this Court in Special Appeal No. 263 of 2014. It is accompanied with an application for condonation of delay. The delay is reported to be of 359 days. An affidavit has been filed in support of the application for condonation of delay, wherein, the cause giving rise to delay in filing the review application is attributed to Covid-19 pandemic. The reasons disclosed in the affidavit are sufficient, hence, the delay is condoned and the application allowed.
We have heard Sri Sudeep Kumar, learned counsel for the review-applicant. In absence of any Rule for the re-evaluation of answer papers, the arguments putforth by the learned counsel for the review petitioner in support of the judgment impugned in the special appeal seem to have been considered satisfactorily by the Division Bench in appeal. The correction of an error postulated in the Rule cannot be stretched beyond a mathematical error. The judgment rendered, therefore, does not suffer from any error apparent on the face of record.
The review petition is accordingly dismissed.
