Order on Exemption Application No. 1 of 2021
Exemption Application is allowed.
The appellant is exempted from filing certified copy of the judgment dated 23.07.2021 to this appeal.
Order on Appeal
The appeal has been preferred against the judgment dated 23.07.2021 whereby the writ petition was dismissed due to availability of a statutory appeal under Rule 11 of Uttar Pradesh Government Servant (Discipline and Appeal) Rules, 1999. It is against the order of punishment.
We do not find any illegality in the order. It is more so when the learned Single Judge has given liberty to file an appeal within three weeks and to be decided on merit, that too expeditiously.
Accordingly, there is no ground to cause interference in the order passed by learned Single Judge and the appeal fails and is dismissed.
Order Date :- 5.8.2021
