Heard learned counsel for the petitioner through video conferencing.
This writ petition under Article 227 of the Constitution of India has been filed for issuing a direction to opposite party no.1 to decide the Regular Suit No. 1934 of 2016 (Praveen Kumar Singh Vs. Satendra Singh & Another) pending in the Court of Additional Civil Judge Court Room No. 44, Lucknow since the year 2016 within specified time fixed by this Hon'ble Court.
Learned counsel for the petitioner submits that the case was finally heard ex-parte and even the written submissions were filed on 12.03.2019 but since then the judgment has not been pronounced. It is relevant to mention here that for last more than a year there has been spread of Covid-19 pandemic and for several months Courts have not functioned properly. Even at present the Courts are not functioning properly because of Covid-19 pandemic rapid spread in the State as well as all over the country.
Considering the aforesaid submissions and facts of the matter, it would be appropriate to direct the trial Court to decide the Suit No. 1934 of 2016 (Praveen Kumar Singh Vs. Satendra Singh & Another) finally within a period of six months, if situation so permits.
With the aforesaid observation, the instant writ petition is disposed of finally.
