This appeal has been preferred by the appellant- Shehan Shah against the judgment and order dated 13.9.1989 passed by IV Additional Sessions Judge, Rampur, in Criminal Sessions Trial No.222 of 1987 (State Vs. Shehan Shah) under Section 302 IPC, P.S.- Patwai, District-Rampur.
Learned A.G.A. has submitted that as per report of the CJM-Rampur dated 21.2.2019, Shehan Shah, sole appellant in this appeal has died and in view of above, this appeal is liable to be dismissed as abated.
We have heard learned A.G.A. and perused the impugned judgment on record and scanned the lower court record very carefully. The submission made by learned A.G.A. appears to be correct.
From the perusal of the report of CJM-Rampur dated 21.2.2019, it transpires that Shehan Shah, sole appellant in this appeal had died eight years ago.
In view of above, this appeal is liable to be dismissed as abated.
The appeal is accordingly dismissed as such.
