This writ petition has been filed, inter alia, for the following reliefs:

i. issue a writ, order or direction in the nature of certiorari quashing the impugned notice dated 19.12.2018 issued by respondent no. 2;

ii. issue a writ, order or direction in the nature of mandamus directing the respondents authorities not to take any coercive action against the petitioner;

iii. issue any other order or direction which the Hon'ble Court may deem fit and proper in the circumstances of the case;

iv. award the cost of the petition to the petitioner.

Heard Sri Ashish Goyal, learned counsel for the petitioner, Ms. Rupal Agarwal holding brief of Sri Ashish Agarwal, appearing for the respondent-Bank and perused the record.

During course of arguments, learned counsel for the petitioner has confined his prayer only for issuance of a direction to respondent no. 2 to fix easy instalments for repay of loan amount.

Considering the facts and circumstances of the case, the petitioner is directed to make an application before the respondent no. 2-Union Bank of India, Dayalbagh Branch, Agra to fix easy instalments for repay of loan amount. In case, such an application is made by the petitioner, the same may be considered by the respondent no. 2 expeditiously in accordance with law.

However, it is made clear that this order will not influence the respondent no. 2 in taking any decision on the application of the petitioner.

With the above observations, writ petition is finally disposed of.
