In this case, notices have been issued to opposite party Nos.4 and 5 and after the order of this Court for issuing notices to the said opposite parties on 07.04.2010, the petitioner has taken steps.

As per office report, the service of notice upon opposite party Nos.4 and 5 have been deemed sufficient and no one has put in appearance for opposite party Nos.4 and 5.

Learned counsel for the petitioner presses urgency in the matter.

It has been informed at the Bar that counter affidavit has been filed by the State-respondents and the petitioner has filed rejoinder affidavit in the identical writ petition bearing Writ Petition No.2131 (S/S) of 2010; Binda Sewak vs. State of U.P. & others.

Learned counsel for the petitioners requests that the aforesaid rejoinder affidavit may be treated as rejoinder affidavit in this case also.

Therefore, list this petition along with Writ Petition No.2131 (S/S) of 2010 in the week commencing 10.12.2018 for peremptory hearing.

Learned counsel for the petitioner shall inform the opposite party Nos.4 and 5 about this order through a letter by registered post within a week and copy of the said letter along with its postal receipt shall also be filed before this Court on or before the next date of listing.

It is made clear that if no one puts in appearance on behalf of the opposite party Nos.4 and 5, the matter may be heard finally considering the submissions of learned counsel for the petitioner and the learned Standing Counsel.
