Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

The present application under section 482 Cr.P.C. has been filed for quashing the impugned N.B.W. order dated 10.7.2015 as well as entire proceedings in S.T. No. 98 of 2011 arising out of Case Crime No. 849 of 2010 (State of U.P. Vs. Sonu Kumar Saket & others), under section 307, 452, 506 IPC, P.S. Shakti Nagar, District Sonbhadra pending in the court of Ist Additional District Judge, Sonbhadra.

Learned counsel for the applicant submits that applicant is innocent and has falsely been implicated in this case. In this case the applicant was granted bail but due to illness he could not appear before the court below due to which non bailable warrant has been issued against the applicant. It is further submitted that applicant has every intention to surrender before the court below and cooperate with the trial.

Considering the facts and circumstances of the case, I do not find any ground to quash the impugned N.B.W. order dated 10.7.2015 and the entire proceeding of the aforementioned case, therefore, the prayer for quashing the same is hereby refused.

However, it is directed that if the applicant appears and surrenders before the court below within 20 days from today and applies for bail, his prayer for bail shall be considered and decided expeditiously, if possible on the same day in accordance with law.

With the aforesaid directions, this application is finally disposed of.
