Heard learned counsel for the petitioner.

Undisputedly, the land upon which the petitioner has raised his construction is a public utility land recorded as Khalihan.

In case the petitioner offers proportionate undisputed land belonging to him for exchange, the impugned order shall remain in abeyance. The petitioner shall tender his offer by moving an appropriate application before the Sub Divisional Magistrate concerned within one week and the Sub Divisional Magistrate shall pass necessary orders by adjusting the land after due evaluation of the same within next four weeks.

The decision so taken shall be brought on record by filing counter affidavit. The benefit of this order shall not be available to the petitioner if he fails to offer the land for public purpose as aforesaid.

List after six weeks.
