Heard Sri Vinay Kumar Tripathi, Advocate holding brief of Sri K. K. Tripathi, learned counsel for the applicant and Sri Dharmesh Chaturvedi, learned counsel for the respondent no.2 and learned A.G.A. for the State of U.P.
Perusal of file shows that five days time was given to the applicant to file the rejoinder affidavit, but even after the span of 11 years applicant has not filed the rejoinder affidavit whereas proceeding in the lower Court are stayed.
Learned counsel for the applicant prays for one week's time to file the rejoinder affidavit.
Learned A.G.A. and learned counsel for the respondent no.2 have submitted that last opportunity be given to applicant to file rejoinder affidavit and no more time be granted to the applicant to file rejoinder affidavit.
Applicant may file the rejoinder affidavit within a week. No more time will be given to the applicant.
