Learned counsel for the petitioner has drawn the attention of the Court to an interim order passed in the case of Bhartiya Khadya Nigam Mazdoor Singh and others v. F.C.I. and others, Writ-A No.38560 of 2016. The said order has been passed after hearing Mr. S.K. Mishra, who is also appearing in this case on behalf of the F.C.I. The relevant part of the judgement is quoted hereinbelow:
"Considering the facts and circumstances, as have been brought on record, it is provided that petitioners, who have not yet joined at their transferred place, shall not be compelled to join till the next date of listing."
The benefit of the interim order passed in the aforesaid case is extended to the petitioners also.
Tag this writ petition with Writ-A No.38560 of 2016 Bhartiya Khadya Nigam Mazdoor Singh and others v. F.C.I. and others.
As prayed by Sri Mishra, three weeks time is granted to file counter affidavit. Rejoinder affidavit, if any, may be filed within a week thereafter.
Put up this case along with the record of Writ -A No.38560 of 2016 before appropriate bench in the additional cause list on 06.10.2016.
