State Of U.P. vs Vikki on 16 June, 2016
Bench: Sudhir Agarwal

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 46

Case :- GOVERNMENT APPEAL No. - 2968 of 2016

Appellant :- State Of U.P.

Respondent :- Vikki

Counsel for Appellant :- G.A.

Hon'ble Sudhir Agarwal,J.

1. This is an application filed under Section 378(3) Cr.P.C. seeking leave to appeal against the judgment and order dated 11.03.2016 passed by Additional Sessions Judge, Court No. 6, District Muzaffarnagar in Special Case No. 58 of 2004 under Section 18/20 NDPS Act whereby accused-opposite party, giving benefit of doubt, has been acquitted. Court below has found that case set up by Police was clearly contradictory and the allegations were not proved at all.

2. Learned A.G.A. could not point out any manifest error or otherwise illegality in the impugned order. Therefore, I find no reason to allow this application.

3. Rejected.
