The writ petition has been filed for a mandamus commanding  respondent authorities to take strict and effective measure against encroachment upon the chak road and chak nali situated in village Barawan Ratti Patti, Pargana Sikenderpur Garvi, Tehsil Belthara Road, Distt. Ballia.

The petitioner has moved an application before the Tehsildar, Belthara Road on 8.12.2015 on which a report has been called for. The report has been submitted by the revenue authorities on 29.12.2015 in which encroachment upon chak road as well as chak nali was found on the spot. In spite of the report neither any order has been passed for removal of encroachment nor any action has been taken against the person who has encroached chak road and chak nali.

Without entering into the controversy involved in the writ petition, the writ petition is disposed of with direction to Tehsildar, Belthara Road, Distt. Ballia to take effective measure on the application of the petitioner dated 8.12.2015 after hearing the parties, expeditiously, if possible within a period of two months from the date of producing a certified copy of this order before him.
