The petitioners have challenged the order of their suspension from service dated 25.8.2014.
The contention of the petitioners is that a preliminary inquiry is yet to be conducted, therefore, the suspension order of the petitioners is not justified. Attention of the court has been invited to the decision of this court dated 17.12.2014 passed in Writ-A No. 69309 of 2013.
Considering the facts and circumstances of the case, the writ petition is disposed of with the direction to the petitioners to move application for revoking their suspension under the relevant rules before the Superintendent of Police, Shahjahanpur, district Shahjahanpur (Respondent no. 3) within a period of 15 days from the date of receipt of this order. If such application is submitted, respondent no. 3 shall consider and decide the same within a period of one months from the date of receipt of certified copy of this order before him in accordance with law. The decision so taken shall be communicated to the petitioners forthwith.
With the aforesaid observations, the writ petition is disposed of.
