Learned A.G.A. has accepted notice on behalf of State of U.P.

Admit and register criminal revision.

Summon the records of trial court.

Heard learned counsel for the accused revisionist as well as learned A.G.A.on bail  application.

Conviction recorded by Trial Magistrate against accused revisionist for offences punishable under sections 354, 323, 324, 506 I.P.C. has been upheld by appellate court vide order dated 14.10.2014 passed  in Criminal Appeal No.59 of 2013 (Brijesh @ Tannu Vs. State of U.P.).

Accused revisionist  was on bail during trial before Magistrate. He was on bail during pendency of appeal also.

In view of above I am of the view that accused revisionist should be released on bail till disposal of this revision subject to condition  that he shall deposit 50%  of fine awarded by trial court for the said offences.

In view of above, bail application is allowed.   

Accused appellant Brijesh @ Tannu shall be released on bail till disposal  of this  revision   on furnishing two sureties with personal bond  each of like amount   to the satisfaction of the  Magistrate concerned subject to condition that  he shall deposit  50%  of fine awarded by trial court and upheld  by Additional Session Judge/Court No.3, District Pilibhit.
