We have heard Sri Ajay Sengar, learned counsel appearing on behalf of the appellant and Sri B.N. Agarwal, learned counsel appearing on behalf of respondent nos. 1,2,3 and 5.

We have perused the impugned order.

Prima facie, we do not find any error in the impugned order. However, we are of the view that it is advisable that the Court should watch the conduct of the respondent for some time and let Km. Rishika @ Mahi live for some time with her father and adjust herself.

It is expected from the father and his wife Dr. Surksha Tyagi to take proper care of their daughter properly with full love and affection. In the circumstances, we direct the appellant to handover the custody of Km. Rishika to respondent no. 1 tomorrow when the respondent no. 1 will go to the residence of the appellant without any hindrance. The respondent no. 1 is also directed to allow the appellant to meet the daughter whenever he desires as per convenience.

List on 16th July, 2014 in Chambers at 3-30 P.M.

On the next date fixed, the respondent no. 1 is directed to appear along with daughter Km. Rishika.
