Learned counsel for petitioner appeared. Learned A.G.A. appeared for respondent nos. 1 to 4. None appeared for respondent no.5. Service of notice on respondent no.5 is not sufficient.

Issue notice to respondent no.5.

Steps be taken within ten days.

Counter affidavit has not been filed on behalf of respondent nos. 1 to 4 even after several adjournments granted for filing counter affidavit.

Respondent no.3 is directed to file personal affidavit within two weeks from today regarding progress of Criminal Case No.177 of 2012, under sections 363, 366 I.P.C., Police Station Sahsawan, District Budaun showing steps taken by police for recovery of corpus failing which respondent no. 3 shall appear in person before the Court on the next date of listing to show cause as to why the order of Court has not been complied with.

List on 16.1.2015 for hearing.
