Argument is that without any show cause notice and opportunity and without holding any inquiry impugned order has been passed although petitioner stood retired in 1998. Averment in this respect has been made in various paragraphs of the writ petition.

Submission is that order has been passed just on the opinion of the District Government Counsel. Petitioner has not been permitted to participate in the inquiry, if any, and therefore, order of the District Excise Officer is liable to be suspended.

Notices meant for respondents have been accepted by learned Standing Counsel.

Counter affidavit may be filed on or before the next date.

List this matter after six weeks.

As an interim measure, operation of the impugned order dated 29th May, 2014 (Annexure-1 to the writ petition) shall remain stayed.
