By means of this writ petition the petitioner has challenged the order dated 18.12.2013  whereby the claim of the petitioner for out of turn promotion has been rejected. The petitioner  is seeking out of turn promotion on account of exemplary act of bravery  in an incident occurred on 31.5.2006 on which date an encounter was carried out and a dreadful dacoit, on whose head there was a prize, was killed by the police party in which the petitioner was also involved.

Learned Standing Counsel submits that provisions for out of turn promotion has been held to be illegal by a Single Judge of this Court in Writ - A No. 60687 of 2013 [Kandwa Kumar Mishra (S.I. in C.P.) Vs. State of U.P. & others] by judgment dated 13.1.2014 against which an appeal was filed and the matter has been referred to the State Government to take a decision with regard to out of turn promotion.

Till such decision is taken, no relief can be granted to the petitioner as has been submitted by the learned Standing Counsel.

The matter requires consideration.

Let a counter affidavit be filed within one month.

List thereafter.
