HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH ?Court No. - 23 Case :- SERVICE SINGLE No. - 592 of 2010 Petitioner :- Neelu Sharma D/O Ram Dutt Sharma Respondent :- State Of U.P. Thru Secy. Basic Education & Ors. Petitioner Counsel :- D.P. Mishra,V.K. Sharma Respondent Counsel :- C.S.C.,Ajai Kr.Singh,D.R. Misra,Rahul Shukla Hon'ble Pankaj Mithal,J.
It is being said that counsel for the Basic Shiksha Adhikhari is avoiding hearing of both the writ petitions. On the last occasion the Basic Shiksha Adhikari (in short BSA) has produced the record and from its perusal the Court was satisfied that petitioner Smt.Neelu Sharma had submitted the domicile and cast certificates before the authority on the last date of submission of forms with the leave of the authority. This was done prior to the finalization of the selection list. However, no counter affidavit on the basis of the record has been filed.
In view of the above situation, the case is directed to be listed peremptorily in the next cause list.
Learned counsel for the BSA if considered proper may file reply on the basis of the record so that the record may not be produced on every date.
