In this Case, on 31.10.2012 following order was passed:

"It is horrible state of affairs that even though suit for specific performance of agreement for sale was not decreed and only an order was passed for return of earnest money along with an extremely meagre rate of interest of 6% per annum still the said amount has not been paid by the petitioner defendant executant of the agreement and the execution proceedings are being delayed. The decree was passed on 05.11.2008 by Civil Judge, Senior Division, Pilibhit in O.S. No.203 of 2000. On inquiry from the Court, learned counsel for the petitioner states that within ten days he will pay the amount.

Accordingly, list in top five cases for further orders on 20.11.2012.

On the said date, a bank draft in the name of respondent payable at Pilibhit of the entire amount due under the decree till the said date, i.e. 20.11.2012 shall be brought in court."

List revised. Learned counsel for the respondent is present. No one is present for the petitioner. Writ Petition is dismissed in default. Executing Court is directed to positively execute the decree within three months from the date of production of certified copy of this order. Ignoring this time limit will not be appreciated by this Court.
