Heard learned counsel for the petitioners and the learned A.G.A.

It is submitted by learned counsel for the petitioners that the FIR in this case was lodged on 29.8.2011 after four years  for the incident which took place on 24.7.2007  and for the same, single blow contusion has been utilized. 

In this view of the matter, issue notice to respondent no. 3.

State and respondent no. 3 may file counter affidavit within four weeks. Rejoinder affidavit,if any, may be filed within two weeks thereafter.

List thereafter before the appropriate bench.

Till the next date of listing or till submission of police report, under Section 173(2) Cr.P.C whichever is earlier, the arrest of the petitioners in case crime No.  344 of 2011, under Section 147, 148, 149, 323, 452, 307, 504, 506 IPC, P.S. Sardhana, district Meerut, shall remain stayed provided they cooperate with the investigation.
