Heard learned counsel for the applicant, learned A.G.A. and perused the record.
Regarding the same incident informant had earlier lodged a report of case crime no.977 of 2011 under Section 384 I.P.C. in which he had not alleged that his chain of gold was snatched which was broken at spot and half portion of chain remained with him and another half portion was taken by miscreants. In that case the applicant has already been granted bail by this Court. On the same facts by adding that his half portion of the chain of gold was snatched by miscreants, this F.I.R. has been registered and the said broken chain is said to have been recovered from the possession of accused-applicant to which he had denied and claimed his innocence.
Learned A.G.A. has opposed the bail.
Considering the facts and circumstances of the case, and the fact that applicant is in jail since 30.9.2011 and the offence is triable by the court of learned Magistrate. I find it fit case for bail.
Let applicant Kuldeep Bangar involved in Case Crime No.978 of 2011 under Sections 379,356,411 I.P.C., Police Station New Agra, District Agra be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
