Citation : 2011 Latest Caselaw 1507 ALL
Judgement Date : 4 May, 2011

Allahabad High Court
Dr. Ram Pratap Singh vs State Of U.P Thru. Secy. ... on 4 May, 2011
Bench: Devi Prasad Singh, S.C. Chaurasia

HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH

?Court No. - 27

Case :- SERVICE BENCH No. - 829 of 2011

Petitioner :- Dr. Ram Pratap Singh

Respondent :- State Of U.P Thru. Secy. Agriculture Eud. & Research & Anor.

Petitioner Counsel :- Ajay Pratap Singh

Respondent Counsel :- C.S.C,Manik Sinha

Hon'ble Devi Prasad Singh,J.

Hon'ble S.C. Chaurasia,J.

Heard learned counsel for the parties and perused the record.

For the same cause of action, the petitioner has already preferred a writ petition, bearing no. 563 (S/B) of 2011 which was finally disposed of by judgment and order dated 30.3.2011 directing the Vice Chancellor to decide the representation of the petitioner within a period of two months from the date of said order.  It has been further provided that till disposal of the representation or for the period of two months, which ever is earlier, status quo shall be maintained by the parties.

The grievance of the petitioner is that in spite of the order dated 30.3.2011, he has not been allowed to continue on the post he was working in the University, although he has not handed over the charge of the post in question.

In this context, it may be observed that since by order dated 30.3.2011, this Court has already directed the parties to maintain status quo, no fresh order is required to be passed in the second writ petition having the same cause of action.

Accordingly, this writ petition too is finally disposed of in terms of the order dated 30.3.2011 passed in earlier writ petition no. 563(S/B) of 2011.  The petitioner may discharge duty till the representation is decided.

(Order Date :- 4.5.2011
