Heard learned counsel for the petitioner and also learned A.G.A. appearing for the State.

As the identity and address of the main co-accused (allegedly) Chhotu Singh to whom the petitioner is said to have introduced to the informant, husband of the victim lady has not been traced. So far the petitioner is concerned, he is allowed ten days time to inform the police about the co-accused Chhotu Singh and assist in getting the said person arrested by the police.

List this case on 1.9.2011.

Till the next date of listing or till submission of police report under section 173(2) Cr.P.C. whichever is earlier, the arrest of the petitioner, namely, Ram Dutt Singh, who is involved in case crime no.769 of 2011, under Section 394 I.P.C., P.S. Chakeri, District Kanpur Nagar shall remain stayed. The learned A.G.A. may also obtain instructions from the Investigating Officer by the said date and also inform to this Court as to whether the petitioner has been cooperating in the investigation and in getting the co-accused arrested.

Copy of the order may be given to the learned A.G.A. by Tuesday, 23.8.2011.
