Heard learned counsel for the applicants, learned A.G.A. and perused the record.

It is contended by learned counsel for the applicants that the applicants are not named in the FIR. During investigation, the name of the applicants have been disclosed by other co-accused. There is no other evidence against the applicants. Rs. 25000/- has been recovered from possession of co-accused Jainendra Prajapati @ Pappu, who has been released on bail by another Bench of this Court on 11.02.2011 in Crl. Misc. Bail Application No. 6405 of 2010. The applicant is in jail since25.08.2009.

In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.

Let the applicants Ratan Paswan and Rakesh Kumar Gupta @ Aazad  involved in case crime no. 703 of 2009, under Sections 302, 201, 394, 411 IPC, P.S. Chopan, District Sonbhadra, be released on bail on their furnishing a personal bond and two heavy sureties each in the like amount to the satisfaction of the Court concerned with the conditions that:-

1. That the applicants shall not tamper with the evidence.

2. That they shall report to the Court of C.J.M. concerned in the first week of each month to show his good conduct and behaviour till conclusion of the trial.

In case of default of any of the above mentioned conditions, the bail granted to the applicants shall be deemed cancelled and he shall be taken into custody forthwith.
