The petitioner as well as respondent no. 5 applied for the post of Aaganwadi Sahaika. The income certificate of respondent no. 5 has been cancelled against which she filed Civil Misc. Writ Petition No. 16778 of 2001, which has also been dismissed. The petitioner filed a complaint before respondent no. 4 that after the cancellation of the income certificate, the appointment of respondent no. 5 on the post of Aaganwadi Sahaika is liable to be cancelled. The respondent no. 4 has disposed of the representation vide order dated 12.5.2011 and upheld the appointment of Smt. Vimla Devi on the ground that she has been appointed not on the basis of income certificate but on the general category on the basis of her age.

Learned counsel for the petitioner submitted that the petitioner is holder of B.P.L. certificate, therefore, under the Government Order the priority should be given to the petitioner.

Respondent no. 4-Bal Vikas Pariyojna Adhikari, Machhali Shahar, District Jaunpur is directed to appear in person and produce the entire record relating to the appointment of respondent no. 5 on 16.8.2011.

Put up on 16.8.2011 as fresh.

A copy of this order be provided to the learned Standing Counsel.
