Learned counsel for the petitioner submitted that the petitioner applied for the appointment of Class III post in Banda Judgeship. She has been selected and appointment letter has also been issued on 30.3.2011 but till date she has not been allowed to join. By the letter dated 7.4.2011, the petitioner has been informed that one Sri Arun Kumar Singh has been transfered from Etawah and, therefore, there is a shortage of one post and, therefore, the appointment of the petitioner cannot be given and in future if there will be any vacancy she will be given appointment.

Learned counsel for the petitioner submitted that when an advertisement has been made for 14 posts and the selection was made for 14 posts and the petitioner has been selected, there is no reason to deny the appointment of the petitioner on the ground that one person has been transferred.

Sri Amit Sthalekar, learned counsel for the respondent is directed to seek instruction in the matter.
