The Delhi High Court has underscored the importance of adhering to the prescribed schedule for medical courses, stating that no dilution is permissible without justifiable reasons. Justice Purushaindra Kumar Kaurav made this observation while dismissing a plea by Sri Satya Sai University of Technology and Medical Sciences challenging the rejection of their request for establishing a new medical college.
The court highlighted that medical education requires top-tier facilities and infrastructure while adhering to strict timeframes to provide premier education to candidates and ensure the community receives well-prepared medical practitioners.
The university's plea was against an order by the Union Government, affirming the decision of the Medical Assessment & Rating Board of the National Medical Commission. The commission rejected the university's application for establishing a new medical college for the academic year 2023-24 due to the absence of any formal application.
The university argued that its application in hard copy was submitted within the stipulated timeframe, but the authorities did not consider this submission. The university's counsel contended that once the application fee was accepted and the hard copy acknowledged, there was no reason for its non-consideration.
In response, the authorities argued that the university did not make any effort to submit the online application, suggesting a deliberate move on their part. The authorities believed that the university was potentially avoiding immediate inspection due to incomplete documents or unprepared infrastructure.
The court noted that sufficient time was available for the university to complete the online application process, which they failed to do. The court dismissed the plea and emphasized that no right was vested in the university to submit offline applications.
The High Court further clarified that the schedule set by apex bodies, particularly for professional courses like MBBS, is designed to accommodate the necessary steps satisfactorily. The inspection stage, especially for medical colleges, is of utmost importance, as it involves scrutinizing minute details to ensure the institution's readiness for medical education.
