The single judge bench of Justice Gurvinder Singh Gill of the Punjab and Haryana High Court in the case of Balvir Ram Vs State of Punjab granted bail to the petitioner solely on the ground of long custody.

BRIEF FACTS

The factual matrix of the case is that the petition is filed for the grant of regular bail for the case registered under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985.

The learned counsel appearing on behalf of the petitioner contended that the petitioner has been falsely implicated in the present case. It has further been submitted that the petitioner has been behind bars for a substantial period of more than 3 years and since the trial is proceeding at snail’s pace, the petitioner deserves the concession of regular bail.

The learned counsel appearing on behalf of the state has contended that since the petitioner was caught red handed with the commercial quantity of contraband, no case for grant of bail is made out.

Union of India, and Mohammad Salman Hanif Shaikh Vs. the State of Gujarat and granted bail to the petitioner granted bail mainly on account of long custody.
