The single judge bench of Justice Arwind Singh Sangwan of the Punjab and Haryana High Court in the case of Gurpinder Singh @ Mannu V state of Punjab granted bail to the petitioner acquitted in two FIRs under NDPS Act.
BRIEF FACTS
The factual matrix of the case is that the present petition is filed for the grant of bail under Sections 22, 25 & 29 of the NDPS Act.
The learned counsel appearing on behalf of the petitioner contended that the petitioner is in custody for a long period of time and only 1 witness is left for examination. Even, the driver of the car from which the possession was made was also granted bail. At last, it was also contended that the petitioner is acquitted in two FIRs under the NDPS act.
The learned counsel appearing on behalf of the state didn’t interject the factual position, however, the acquittal of the petitioner in two FIRs could not be verified by the said Investigating Officer.
COURT’S OBSERVATION
The hon’ble court after considering the facts and circumstances of the case granted bail to the accused on the ground that the petitioner is in long custody and only 1 witness has been examined further, the petitioner is already acquitted in two FIRs under the NDPS act.
