The Calcutta High Court Bench comprising Chief Justice Prakash Srivastava and Justice Rjashri Bharadwaj dismissed the petition which challenged the School Reopening order of the West Bengal Government directing reopening of schools from November 16 for the students of Class IX to XII. 

Background of the Case

This Petition was filed challenging the order of the State of West Bengal dated 29 October, in which the state ordered for the opening of schools with the maintenance of COVID guidelines. Advocate Sudip Ghosh Chowdhary alleged that the State Government had started to run the classes of IX to XII students without any proper set of care and planning, which is risky and students shall be prone to the risk of Coronavirus. 

It was further contended by the Petitioner that students up to the age of 18 years are not vaccinated yet and physical classes would only increase the chance of COVID transmission. 

The plea sought the formation of an expert committee for the review of covid situations in the State and recommending State for the same. 

Submission of Advocate General

S.N Mookherjee, Advocate General contended that most other states such as Bihar, Chandigarh, Andhra Pradesh had already re-opened the school. He contended that the state will run everyday awareness programmes regarding safeguard mechanisms against the transmission of Coronavirus. 

Order of the Court

The Court refused to entertain the plea and dismissed the Petition, leading to an open gate for enforcing reopening order of State Government.
