Rajasthan Civil Services (Medical Attendance) Rules, 1970

In exercise of the powers conferred by proviso to Article 309 of the Constitution the Governor hereby makes the following Rules, namely:-
Note: - Amendments made after 1980 alone are shown separately.
- Short Title & Commencement.- (1) These rules may be called the Rajasthan Civil Services (Medical Attendance) Rules, 1970.
(2) They shall come into force with effect from 1st March, 1970.
- Extent of Application.- (1) These Rules shall apply to :-
(i) All Government servants (including probationers) whose conditions of service are regulated or deemed to be regulated by the Rajasthan Service Rules, when they are on duty or on leave (including leave preparatory to retirement) in the Rajasthan, or in any State or Union Territory of India, or while under suspension;
(ii) re-employed persons;
(iii) all Government servants on foreign service or on deputation from Central/other State Governments and vice versa unless anything otherwise is provided in the terms of deputation.
(iv) retired Government servants "including retired members of the All India Services belonging to the Rajasthan Cadre" to the extent indicated in Rule 11 of these rules: and
(v) [Retired Judges of the Rajasthan High Court to the extent indicated in Rule 11 of these rules].
(2) these rules shall not apply to :-
(i) those Government servants who are governed or covered by the Employees State Insurance Act and Schemes framed under the said Act. Government establishments to which the Employees State Insurance Act is applicable are indicated in Appendix I;
(ii) those Government servants who are on leave or deputation abroad;
(iii) work-charged, casual and part-time employees, except when these rules are specifically made applicable to them under their service rules;
(iv) persons appointed on contract basis unless otherwise provided in the terms of contract;
(v) officer of All India Service;
(vi) Government servants who proceed outside Rajasthan on leave with the object of securing Medical Attendance outside Rajasthan for themselves or their members of family.
(3) Definitions. - In these rules, unless there is anything repugnant in the subject or context.-
(1) "Authorised Medical Attendant" in respect of a Government servant or class of Government servants at a station or area means :-
(i) a Medical Officer of the Rajasthan Medical Department on duty in a hospital or dispensary; or
(ii) a Medical Officer on duty in a Non-Government Medical Institution recognised as "Government Hospital" under sub-clause (viii) and nominated by the Director of Medical & Health Services; or
[(iii) a Government Chikitsak in Ayurved/Unani and Homeopathy nominated by the Director of Ayurvedic Department].
[Explanation. - An Authorised Medical Attendant for one spell of illness shall be either a Medical Officer or a Chikitsak].
(iv) "Director of Medical & Health Services" means the Head of the Medical Department in Rajasthan;
(v) "State" means State of Rajasthan;
(vi) "Director of Ayurvedic Department" means the Head of the Ayurvedic Department in Rajasthan;
(vii) "Government" means the Government of Rajasthan;
[(viii) Government Hospital means a Medical\Ayurvedic \Unani or Homeopathy Hospital\ Dispensary or institution maintained by the Government for purpose of Medical \ Ayurvedic \ Unani or Homeopathic treatment and also includes a dispensary or a hospital maintained by a local authority, or a hospital within the state or outside the State with which arrangements have been made by the Government for the treatment of Government servants];
Note.- List of dispensaries \ hospitals with which arrangements have been made by the Government for treatment of Government servants is given in Appendix II.
(ix) "Family" means Government servant's wife (not more than one) husband (in the case of a woman Government servant), children including children adopted legally and parents, if wholly dependent upon the Government servant.
[Note.- The condition of dependence both in the case of husband or wife of the Government servant has been dispensed with provided the Government servant has exercised an option, intimating the Appointing Authority, that claims of medical reimbursement will be made to Government for the spouse even though his/her spouse is employed elsewhere in a body having prescribed procedures for reimbursement of medical expenses. Such option can be revised only with Government approval].
Explanation: - (a) For the purpose of this clause the parent does not include step parents.
(b) For the purpose of this clause the parent shall be regarded as wholly dependent upon the Government servant if they normally reside with the Government servant at the place of his duty and their total monthly income from all sources does not exceed [Rs. 1000/-]. Lump sum non-recurring income e.g. Contributory Provident Fund, gratuity, Government of India's Prize Bonds, insurance benefits etc. shall not be regarded as income for the purpose of this clause but recurring monthly income from sources such as house, land holding etc. should, however, be taken into account for the purpose of assessing income.
(c) A declaration regarding income and the residence of parents shall be furnished by the Government servants once in the beginning of every calendar year. In case the declaration is submitted subsequently, the reimbursement shall be admissible in respect of parents who undergo treatment after the date of submission of the declaration.
(x) "Medical Attendance" means in respect of a Government servant, attendance in a Government Hospital or the clinic of the authorised medical attendant or in the case of illness which compel the patient to be confined to his residence, at the residence of the Government servant by the authorised medical attendance and includes:
(a) such pathological, bacteriological, radiological or other methods of examination for the purpose of diagnosis as are available in any Government Hospital or laboratory in the State and are considered necessary by the authorised medical attendant, and
(b) such consultation with any other medical officer or specialist in the service of the Government as the authorised medical attendant certifies to be necessary, to such extent and in such manner as the medical officer or the specialist may, in consultation with the authorised medical attendant, determine.
(xi) "Patient" means Government servant who has fallen ill and to whom these rules apply ;
(xii) "Treatment" means the use of all medical and surgical facilities available at the Government Hospital in which the patient is treated, and includes:
(a) the employment of pathological, bacteriological, radiological or any other methods as are considered necessary by the authorised medical attendant.
(b) dental treatment where the diagnosis of the physiological or other disability from which a patient is suffering indicates that the teeth are the real source of disturbance provided it is of major kind such as treatment of bone disease, wholesale removal of teeth or impacted wisdom teeth but it excludes treatment for Pyorrhea and Singivities of teeth.
(c) surgical operations needed for the removal of Odontomes including the oral surgery of the mouth.
(d) the supply of such medicines, vaccines, sera or other therapeutic substances as are ordinarily available in Government hospitals in the State.
(e) the supply of such medicines, vaccines, sera or other therapeutic substances not ordinarily so available, as the authorised medical attendant may certify in writing to be essential for the recovery or for the prevention of serious deterioration in condition of the patient, but excluding medicines which are regarded as food, toilets, tonics having more food value, disinfectants and other similar preparations.
(f) Confinement in Government Hospital and pre-natal and post- natal treatment of wife of a Government servant and a female Government servant.
(g) provision of accommodation in Government hospitals on the scale and subject to the conditions mentioned in rule 4 (1).
(h) consultation fee charged by the Authorised Medical Attendant from Government servants for attendance at residence of the patient as per schedule contained in Appendix 'X' of the Rajasthan Service Rules, Vol. II and also fee charged by Compounder/Nurse for administering injection at the residence of the Government servant as per rates laid down in above mentioned Appendix 'X'.
(xiii) 'Pay' for the purpose of these rules means pay as defined in rule 7 (24) of Rajasthan Service Rules but it excludes Special Pay.
- Free Medical Attendance and Treatment to Government servants.- (1) A Government servant shall be entitled to medical attendance and treatment free of charge in accordance with provisions of these rules.
(2) (i) The expenses incurred by a Government servant on account of medical attendance and treatment shall on production of essentiality certificate from the Authorised medical attendant in the prescribed form, be reimbursed to him to the extent and in manner provided in these rules.
(ii) The following charges paid by the Government servants for treatment are reimbursable:-
(a) Cost (including sales tax paid by the Government servant on medicines purchased) of Allopathic Drugs, medicines, vaccines, Sera or other therapeutic substances not ordinarily available in Govt, hospitals. List of allopathic drugs, medicines which are not reimbursable is given in Appendix III.
(b) Cost (including Sales Tax paid by the Government servant on medicines purchased) of Ayurvedic and Unani drugs approved preparation only not ordinarily available in Government hospital. List of Drugs which are reimbursable is given in Appendix IV.
(c) Ambulance charges incurred to convey the patient from residence to a Government hospital vice versa or from one Government hospital to another for treatment or examination, if the ambulance belongs to Government or the Government hospital where patient is admitted.
(d) Blood transfusion charges.
[(e) Cost wholly or partly of hearing aid or artificial limb (including cost of replacing a limb) or calipers.]
[If a hearing aid equipment is required to be purchased again on the opinion of the competent authorised medical attendant and that the earlier equipment is beyond repairs, the reimbursement of cost would be limited to 50% only.]
(f) Consultation fee charged by the authorised medical attendant from the Government servant for treatment of Government servant at his residence to the extent and on scale laid down in the schedule given in Appendix 'X' of Rajasthan Service Rules Vol. II.
(g) Fee paid to Compounder/Nurse per visit for administering injection at the residence of Government servant to the extent and on the scale laid down in the schedule given in Appendix 'X' of Rajasthan Service Rules, Volume II.
[(h) X-Ray charges paid by the Government servant in a Government hospital/dispensary/clinic.]
[(i) Cost (including Sales Tax paid by the Government servant on medicines purchased) of Homeopathic drugs of approved preparation only, not ordinarily available in the Government Hospitals. List of Pharmacist as well as list of medicines which are reimbursable is given in Appendix 12.]
[(j) Consultation fee charged by the authorised medical attendant and fee paid to Compounder/Nurse for administering injections in case of Homeopathic treatment at the residence of the Government servant will not be reimbursable.]
[(k) the charges paid by the Government servants in a Government Hospital under Auto Finance Scheme for pathological, bacteriological and radiological tests, X-Ray, Dialysis and investigation etc. which are considered necessary by the authorised medical attendant.]
[(l) Actual cost of Intra-Ocular Lens implantation and the treatment thereto, if undertaken in Government Hospital.]
[(m) Cost of Subcutaneous Infusion Pump-an instrument for use of blood transfusion.]
- Treatment at Government Hospital as Indoor/Outdoor patient etc.- (1) A Government servant who-receives medical attendance and treatment at a Government hospital as an indoor patient shall be entitled to the following concessions :-
[(a) (i) Accommodation in the Government hospital as classified below shall be provided free of charge subject to the availability:-

| (b) | Rs. 2000/- or above but below Rs. 3500/- | Cottage Ward. |
| (c) | Above Rs. 800/- but below Rs. 2000/- | Rental Ward of the lowest category. |
(ii) If the class of accommodation to which a Government servant is entitled to under sub-clause (i) above is not available, accommodation of a higher class may be provided if the admission of patient can not be delayed without danger to his health. The Superintendent/ Principal. Medical & Health Officer of the hospital shall record this fact in the appropriate hospital records.
(b) Ordinary nursing facilities available in a Government hospital.
(c) Free diet in case of Government servant whose pay does not exceed [Rs. 1150/-] per month if arrangements exist for dieting patients.
(d) Free medical attendance and treatment as provided in rule 3.]
(2) Treatment at Government hospital as out-door patient. - A Government servant who receives medical attendance and treatment at a Government hospital as an out-door patient shall be entitled to concessions provided in rule 3.
(3) Treatment at residence. - If the Authorised Medical Attendant is of opinion that owing to absence or remoteness of suitable hospital or to the severity of the illness, a Government servant can not be given treatment as provided in sub-rule (1) and (2) of this rule, he may receive medical attendance and treatment at his residence under rule 3.
(4) Admissibility of Travelling Allowance to ailing Government servants in certain circumstances. - (i) If a Government servant falls ill at a place which is not the Headquarters of the Authorised Medical Attendant, he shall be entitled to travelling allowance as on tour except the halting allowance for the journey to and from such headquarter provided that he does not undertake journey for attendance by a dentist or an occulist. In case the condition of the ailing Government servant is so serious that he cannot be carried to the headquarters of the Authorised Medical Attendant in any conveyance, the Authorised Medical Attendant attending the patient at his residence shall be entitled to Travelling Allowance as on tour for forward and return journey from his headquarters to the place of residence of the ailing Government servant under Travelling Allowance Rules.
(ii) If the Authorised Medical Attendant is of opinion that the condition of the patient is so serious or of special nature as to require medical attendance by a specialist medical officer other than himself, he may send the patient to the nearest specialist or other medical officer concerned. The ailing Government servant sent to another, station from the headquarters of the Authorised Medical Attendant shall be entitled to Travelling Allowance as on tour without any halting allowance for the forward and return journey from and to the headquarters of specialist or other medical officer. An attendant escort accompanying the patient under written instructions from the Authorised Medical Attendant for the safety of the patient shall also be entitled to Travelling Allowance on the scale admissible to the Government servant himself on tour without any halting allowance. In case a Government servant travels by air or in air-conditioned class for this purpose, the travelling allowance shall be limited to travelling allowance admissible to him for journey by rail (except in air-conditioned coach)/Road under Rajasthan Travelling Allowance Rules, as on tour without any halting allowance.
- Medical Attendance and Treatment of members of family of a Government servant.- (1) The members of the family of a Government servant shall be entitled to free medical attendance and treatment at a Government hospital on the scale and conditions allowed to a Government servant himself under rule 3 and sub-rule (1), (2) & (3) of Rule 4. For the purpose of admissibility of concessions under this rule, it is not necessary that the member(s) of the family of a Government servant should reside with him at the time of illness.
(2) Where both husband and wife are Government servants, they shall be entitled to medical attendance and treatment as independent entity according to his/her status under these rules. In such case the claim for reimbursement of medical expenses of the members of family dependent upon them shall be preferred by either husband or wife whoever is in receipt of higher pay.
- Medical attendance and treatment outside Rajasthan.- [(1) A Government servants including members of his family posted to a station or sent on duty or spending leave or otherwise at a station outside Rajasthan in India and who fails ill shall be entitled to free medical attendance and treatment as an indoor and outdoor patient in a Hospital maintained by the Central Government or other State Government on the scale and conditions which would be admissible to him under these rules, had he been on duty or on leave in Rajasthan.]
(2) For the purpose of this rule "Authorised Medical Attendant" in respect of a Government servant or class of Government servant at a station outside Rajasthan shall mean an officer of Medical Department of Central or other State Government (as the case may be) on duty in a Government Hospital or Dispensary at that station.
[(3) The charges paid by the Government Servant posted at Delhi to the following private hospitals/clinics for X-Ray, Pathological, Bacteriological, Radiological tests and other kind of investigations which are considered necessary by the doctor of the State Government posted in Delhi, shall be re-imbursed:-
- Sunderlal Jain Charitable Hospital, Ashok Vihar,
- Massonic Charitable Polyclinic, Janpath, and
- Sir Gangaram Hospital, Rajendra Nagar.]
- Treatment of a disease for which treatment is not available in the State.- (1) A Government servant and the members of his family suffering from a disease for which treatment is not available in any Government hospital in the State shall be entitled to medical attendance and treatment to the extent indicated in sub-rule (2) of this rule in a Hospital/Institution outside the State recognised by the Government, provided that it is certified by the Principal of a Medical College/Director of Medical & Health Services on the basis of opinion of the Authorised Medical Attendant to the effect that the treatment of a particular disease from which the patient is suffering is not available in any Government Hospital in the State and it is considered absolutely essential for the recovery of the patient to have treatment at a hospital outside the State.
(2) The following charges / expenses shall be reimbursable:-
(a) Cost (including Sales Tax) of Allopathic Drugs, Medicines, Vaccines, Sera or other therapeutic substances reimbursable under these rules.
(b) Sums actually paid to the Hospital/Institution on account of medical attendance and treatment including charges for surgical operations and ordinary nursing facility.
(c) Travelling allowance for journey by rail/road from duty point at the station at which the patient falls ill to the place of treatment outside the State and back to a single fare of the class to which his classification entitles him under Rajasthan Travelling Allowance Rules. Such travelling allowance shall also be admissible for an attendant, if the Authorised Medical Attendant certifies in writing that it is unsafe for the patient to travel unattended and that an attendant is necessary to accompany the patient to the place of treatment and back.
(3) The facility of medical attendance and treatment in the type of cases mentioned in sub-rule (1) can be had at any of Hospitals/Institutions mentioned in Appendix 11.
(4) For the purpose of reimbursement, the original receipts issued by such Hospital/Institutions and vouchers of medicines etc. shall be countersigned by the Authorised Medical Attendant of Government Hospital on whose advice the treatment outside the State was undertaken.
[7A. Grant of advance for medical attendance and treatment outside the State. - (1) A Government servant and member(s) of his family, who are entitled to free medical attendance and treatment outside the State in terms of Rule 7 may be granted advance equivalent of the amount considered sufficient for the required medical attendance and treatment by the Principal of a Medical College or the Director, Medical & Health Services or Rs. 5,000/- whichever may be the less. The estimated amount of reimbursable expenditure on medical attendance and treatment outside the State should invariably be indicated in the certificate to be given by the Principal or the Director, Medical and Health Services.
(2) The advance shall be sanctioned by the Head of Office keeping in view the estimated amount of expenditure indicated in the certificate or the pecuniaiy limit mentioned in sub-rule (1).
(3) The advance shall be debited to head of account to which pay and allowances of the Government servant are debited.
(4) (i) Once an advance has been sanctioned, further advance shall not be allowed until the medical reimbursement claim(s) to the extent of amount of previous advance has been submitted for adjustment.
(ii) The entire amount of advance shall finally be adjusted against the due medical reimbursement claim under these rules not later than the expiry of a period of one month from the date of release of the patient from the hospital. The unspent amount of advance, if any, shall invariably be paid in cash.]
- Procedure for claiming reimbursement.- The procedure to be followed for claiming reimbursement of expenses incurred by a Government servant on account of medical attendance and treatment under these rules shall be as follows:-
(1) Every Government servant claiming refund of medical expenses incurred on account of medical attendance and treatment for himself and/or members of his family, shall make an application in duplicate in form given in Appendix 5. [Such claims shall be presented within two years from the date of completion of treatment].
(2) (i) Each form of application referred to in clause (1) shall be accompanied by an Essentiality Certificate from the Authorised Medical Attendant in Form given in Appendix 6 alongwith any other certificate(s) required to be attached under any rule. A duplicate copy of the Essentiality Certificate signed by the Authorised Medical Attendant shall be prepared by the concerned Government servant for attaching it with the duplicate copy of the application form referred to in sub-rule (1).
(ii) The cash memo attached to the medical bills, for purchase of medicines shall be verified and signed by Authorised Medical Attendant prescribing the medicines.
(iii) A Government servant or member of his family who receives medical attendance and treatment at his residence under rule 4 (3) shall be reimbursed the consultation fee charged by the authorised medical attendant and/or fee paid to Compounder/Nurse for administering injection on production of a certificate from the Authorised Medical Attendant in the prescribed Form given in Appendix 8. This certificate shall be attached with the application for claiming fee paid to Compounder/Nurse for administering injection at the residence of the Government servant a certificate from the Authorised Medical Attendant in the Form B given in Appendix 8 shall be appended to the application Form.
(iv) Every Authorised Medical Attendant while signing the Essentiality Certificate shall make an entry in the register in the prescribed form given in Appendix 7 in the serial order of issue of such certificate or alternatively a copy of the Essentiality Certificate alongwith the form of application shall be retained in support of the entries shown in Columns 3 to 7 of the prescribed register. He shall indicate the Serial Number (with date) at which the entry has been made in the aforesaid register on the Essentiality Certificate. The register maintained by the Authorised Medical Attendant shall be available for inspection and check without notice by the District Medical & Health Officer or Superintendent of the Hospital or any other officer authorised by the Government from time to time.
(3) (i) (a) The bill for medical expenses shall be drawn in the form prescribed for drawing pay and allowances of Government servants and charged to the budget head to which pay and allowances are debited.
(b) Claim for Travelling Allowance admissible to ailing Government servant and or attendant/escort under sub-rule (4) of rule 4 of these rules shall be drawn on Travelling Allowance Bill form. Such a travelling allowance claim shall be accompanied by a certificate from the Authorised Medical Attendant permitting the Government servant alone or with attendant/escort, where necessary to undertake journey.
(ii) The bill shall be countersigned by the authority competent to sign the Travelling Allowance bill of the Government servant concerned.
(4) A Government servant shall present a consolidated claim for reimbursement of medical expenses not earlier than once in a month in respect of all the members of his family including himself/herself after the treatment is over. [In case where treatment continues over a long period, a part claim for reimbursement of medical expenses may be presented by the Government servant as follows:-

- (1) The claim for reimbursement of medical expenses upto Rs. 25/- in case of allopathic medicines presented by a Government servant for himself and members of his family under these rules shall be paid on the basis of prescription of the Authorised Medical Attendant.
[Provided that at places where purchase of Allopathic medicines through Co-operative Shops run by the Upbhokta Sahakari Sangh/Bhandar is provided, the maximum ceiling for presenting the claim in such cases shall be Rs. 50/-]
(2) (i) The procedure for claiming reimbursement in the type of claims referred to in sub-rule (1) of this rule shall be the same as laid down in rule 8 of these rules except that the provisions of clause (i), (ii) and (iv) of sub-rule (2) of rule 8 shall not be applicable in such cases.
(ii) The prescription of the Authorised Medical Attendant referred to in sub-rule (1) of this rule shall bear O.P.D. registration number and date of the hospital/dispensary where treatment is undertaken, and the Authorised Medical Attendant shall subscribe his signature on such prescription under his official seal.
- Special Concessions to Government servants suffering from Tuberculosis and Cancer.- A Government servant suffering from Tuberculosis and Cancer shall be entitled to the following special concessions:-
(1) Reasonable facilities shall be provided to the Government servants for admission to a Government Sanatorium, in cases where institutional treatment is considered necessary under advice of the Authorised Medical Attendant.
(2) A Government servant admitted as an indoor patient in a Government Hospital/T.B. Sanatorium/Clinic shall in addition to expenses on medicines reimbursable in accordance with provisions contained in rule 3 of these rules, be allowed reimbursement of the expenses incurred by the Government servant on non- reimbursable medicines i.e. medicines having more food value on the following conditions :-
(i) The medicines are prescribed by the Medical Officer of the Government T.B. Hospital/Sanatorium.
(ii) The amount to be reimbursed under this clause shall not exceed Rs. 50/- per month.
(iii) The amount shall be reimbursable on production of vouchers duly countersigned by the Medical Officer attending the case alongwith a certificate from the Medical Officer in Form 'A' given in Appendix 9.
(iv) The Travelling Allowance shall be admissible for any journey undertaken in the circumstances mentioned in rule 4 (4) of these rules to the extent admissible under the rail concessions allowed to T.B. and Cancer patients by Railways as given in Appendix 10.
(v) an allowance not exceeding Rs. 75/- per month shall be paid towards the cost of special diet, if any, prescribed by the Authorised Medical Attendant to the Government servant (whose pay does not exceed [Rs. 2150/-] (per month) subject to the production of a certificate signed by the Government servant and countersigned by the Medical Officer attending on him in Form 'B' given in Appendix 8.
Clarification. - Attention is invited to Rule 10 (2) of the Rajasthan Civil Services (Medical Attendance) Rules, 1970 under which a Government servant suffering from T.B./Cancer when admitted as an indoor patient in a Government Hospital/T.B. Sanatorium/Clinic is entitled to special concessions provided therein.
A question has been raised as to whether the concessions provided in Rule 10 (2) shall also be admissible to the members of the family of the Government servant when they are treated as outdoor patient in view of sub-rule (3) & (5) of Rule 10. The matter has been examined and it is clarified that concession provided in Rule 10 (2) of the aforesaid rules are not admissible to members of the family of a Government servant when they are treated as out-door patient.
Past claims already decided otherwise need not be reopened but pending claims may be decided under these orders.
(3) The concession outlined in clause (2) shall also be admissible to a Government servant who is on leave and is being treated as an out-door patient on the advice of the Medical Officer Incharge of Government Hospital/T.B. Sanatorium or Clinic.
(4) (a) When a Government servant is admitted in a private Sanatorium in Rajasthan after he has obtained a certificate from Medical Officer incharge of Government Hospital, T.B. Sanatorium or Clinic for non-availability of accommodation, the Government shall assist in the payment of following charges in respect of Government servants whose pay does not exceed [Rs. 2150/-] per month.
(i) Amount not exceeding Rs. 50/- per month for charges on ordinary accommodation in the private Sanatorium if paid by him.
(ii) Amount not exceeding Rs. 75/- per month towards the cost of special diet, if any, prescribed by the Medical Officer of the Sanatorium under the conditions laid down in sub-clause (v) of clause (2) above for such employees.
(iii) Charges for non-reimbursable medicines not exceeding Rs. 50/- per month shall also be paid on the conditions as laid down in clause (2) above for such charges.
(iv) Travelling Allowance as provided in sub-clause (iv) of clause (2) of this rule.
(b) During institutional treatment in a private Sanatorium ordinary medicines reimbursable under the Rules shall also be reimbursable on certification by Medical Officer incharge of the private Sanatorium.
(5) Subject to the provisions contained in rule 5, the concessions laid down in this rule shall also be admissible to the members of family of the Government servants on the conditions on which they are admissible to Government servants themselves provided the treatment is taken as indoor patient and not otherwise.
- (1) A Government servant who is retired from service on pension or with Contributory Provident Fund benefits shall be entitled to the following concessions:-
(a) Free medical attendance and treatment in a Government Hospital/Clinic as an indoor and outdoor patient except (i) reimbursement of cost of medicines, vaccines, sera or other therapeutic substances purchased from the market on the advice of Authorised Medical Attendant (ii) consultation fee charged by the Authorised Medical Attendant for attendance at his residence (iii) fee charged by Compounder, Nurse for administering injection at his residence.
(b) Free accommodation in the Government Hospital of the category to which he was entitled immediately before retirement subject to availability under rule 4 (1) (a) of these rules.
Order:- According to Rule 11 (1) (b) of the Rajasthan Civil Services (Medical Attendance) Rules, 1970, a retired Government servant is entitled to free accommodation in the Government Hospital of the category to which he was entitled immediately before retirement. As the accommodation in the Hospital is to be provided according to their status based on pay which they were drawing at the time of retirement, difficulty is faced by the Hospital authorities in the verification of the status of the retired Government servant and the pensioners are asked to produce certificate of last pay drawn.
The matter has been examined and the Governor has been pleased to order that in the case of Government servants (non-gazetted and gazetted) retiring on or after the date of issue of these orders an extra copy of Last Pay Certificate be given invariably to the pensioner at the time of retirement by the Head of Office or Treasury Officer as the case may be. On the basis of such Last Pay Certificate received by the pensioner it would be possible to verily his status by the Hospital authorities.
In respect of those retired before the issue of these orders a certificate of last pay drawn may be given by the Head of Office /Head of Department.
(2) In case of a Government servant who dies while in service after retirement, the concession provided in sub-rule (1) shall be admissible to the person who is in receipt of family pension. The procedure prescribed in sub-rule (4) shall mutatis mutandis also apply in their case.
(3) The wife of a retired Government servant wholly dependent upon him shall also be entitled to concessions provided in sub-rule (1).
(4) (i) Every retired Government servant who avails himself of these concessions under this rule shall be required to sign a declaration on each occasion before the Medical Officer incharge of Hospital/Dispensary in the following form :-
"I hereby declare that-
(i) I am not employed in any Government department, autonomous bodies like Municipalities, Universities etc., grant-in-aid institutions, public sector or private sector undertakings, statutory or non-statutory corporation, companies and commercial or industrial firms etc., and that I am not carrying on any business or trade to earn my livelihood.
(ii) That my wife is wholly dependent upon me.

(ii) Every retired Government servant who avails himself of the concession indicated in sub-rule (1) of this rule shall be required to produce his pension payment order or a certificate from the Head of office or Department to the effect that he retired from Government service with Contributory Provident Fund Benefits, as the case may be, before Medical Officer Incharge of Hospital/Dispensary for the purpose of identification.
[11A. A retired judge of the Rajasthan High Court, who can not avail himself of the medical facilities available under Central Government Health Scheme on account of non existence of such a Scheme at the place where he resides in the State, shall be entitled to the Medical facilities and concessions to the extent indicated in Rule 11 of these Rules.]
- Savings.- Nothing in these rules shall be deemed to-
(1) entitle a Government servant to reimbursement of any cost incurred in respect of medical services obtained by him or to travelling for any journey performed by him otherwise than an expressly provided in these rules; or
(2) prevent the Government from granting to a Government servant any concession relating to medical treatment or attendance or travelling allowance for any journey performed by him which is not authorised by these rules.
- These rules supersede the Rajasthan Services (Medical Attendance) Rules, 1958 and all orders issued thereunder and the pending cases shall be dealt with in accordance with provisions of these rules.

Important Orders
(I)
Subject: Scrutiny of Claims for Medical Reimbursement.
Cases of suspicious claims made by some Government servants, on account of medical reimbursement, have been brought to the notice of the Government from time to time. The Government have considered the matter and have decided that in order to minimize the chances of doubtful or false claims and also to keep a close watch over the medical reimbursement claims, the following instructions are laid down :-
(1) Register of Medical reimbursement claim bills, as per the. proforma, appended herewith shall be opened with effect from 1st April, 1970 wherein the bills be entered immediately, the moment they are presented. The entries will be signed by the Upper Division Clerk/Accounts Clerk/Accountant maintaining the Register and the authority competent to countersigned such claims under Rajasthan Civil Services (Medical Attendance) Rules, 1970. The register shall be open to inspection by inspecting authorities and also, by the Accountant General or his representative. In case of Government Secretariat, every Secretary of the Administrative Department shall nominate one of the Deputy Secretaries who shall exercise control over the medical reimbursement claims presented by all the Gazetted as well as non-Gazetted Government servants posted in his administrative Department and shall also sign the entries in the Register before passing on claims to the Accounts Officer of the Secretariat for arranging payment.
(2) If the medical reimbursement claims of a Government servant drawing pay of less than Rs. 500/-, amounts to Rs. 1,000/- or more in a year, the countersigning authority shall scrutinise them fully to find out the genuineness of such claims. In the case of other Government servants, the countersigning authority should scrutinise the cases of such of them Rs. 1,000/- or their one month's pay whichever is higher. In such cases, the countersigning authority, in his discretion, may refer for special medical check up by an authority higher than the Authorised Medical Attendant who is treating the patient. The term 'pay' used in this para means pay as defined in rule 7 (24) of Rajasthan Service Rules excluding special pay and dearness pay.
(3) (i) Where the countersigning authority, after careful scrutiny as indicated above finds the medical reimbursement claim prima-facie false, wholly or partially, he will send a comprehensive report, supported by the documentary evidence collected during the scrutiny of the claim, to the Appointing Authority or Government as the case may be, who may after further verification, if necessary, and after satisfying about the correctness of the report so received and after arriving at a decision that the action under criminal law is desirable will refer the matter to the Anti Corruption Department for the registration of the case and investigation in terms of the instructions as laid down in Government Circular No. F. 6 (10) Apptts. (A-IIU/67, dated 12-4-1967, a copy of which is enclosed for ready reference, When the countersigning Authority is himself the Appointing Authority, he may report the matter to the Anti Corruption Department.
(ii) Where a prima-facie case of forgery or cheating is made out, the Countersigning authority shall straight-away hand over the case to the police by lodging F.I.R.

Reference is invited to the Circulars No. F. 23 (36) Apptts. (A)/57, dated 22-8-1957 and 25-4-60, issued by this Department in which it was laid down that all complaints (including anonymous or pseudonymous complaints) of corruption, bribery, criminal misconduct, misappropriation of Government funds, embezzlement etc. should be transferred to the Special Inspector General of Police, Anti-Corruption Department in respect of all Government servants, whether Gazetted or Non-gazetted. It was further desired that in such cases as are found fit for prosecution in a Court of Law by the Anti-Corruption Officer no departmental enquiry should be conducted prior to issue of sanction' for prosecution or even when prosecution had advanced, except with the specific consent of the Anti-Corruption Officer. In cases of embezzlement, however, an exception was made that departmental enquiry could be instituted simultaneously alongwith police investigation.
As a result of the review of the working of the above arrangements the Government are of the view that the responsibility for preliminary enquiry into complaints of corruption against Non-gazetted officers should primarily rest with the Departments concerned; except when specifically provided otherwise. The Government have, therefore, decided that in partial modification of the Circular referred to above the following procedure shall hence forth be followed :-
(1) All complaints of corruption etc. against Gazetted Government servants shall continue to be referred to the Anti-Corruption Officer as before.
(2) All complaints of corruption etc. against Non-gazetted Government servants of the Police Department shall also be referred to the Anti-Corruption Department as before.
(3) All complaints of corruption etc. against Non-gazetted public servants (other than those of the Police Department), received from whatever source shall not normally be sent to the Anti- Corruption Officer, but shall first be dealt with by the Head of the Department concerned by initiating proper preliminary enquiry. Only those cases in which preliminary enquiry has disclosed facts which warrant criminal action need be sent to the Anti-Corruption Officer for registration of a regular investigation. The Head of the Department may in his discretion refer a case to Anti-Corruption Department even after final Departmental enquiry has been held if the circumstances so warrant. The Head of the Department shall be assisted in this work by the Vigilance Officer appointed for his Department by the Vigilance Commissioner.
(4) The complaints against Non-gazetted public servants (other than those of the Police Department) received direct by the Government, the Vigilance Commission or the Anti-Corruption Department shall, when it is not proposed to initiate police investigation straight away, be forwarded to the Head of the Department concerned for departmental action.
(5) The Deputy Inspector General of Police, Anti-Corruption Department may of his own motion or on advice from the Vigilance Commissioner start action on any complaint of corruption etc. against a non-gazetted public servant in any particular case and inform the concerned Head of the Department. In such case the Head of the Department shall not initiate departmental action except with the consultation of the Anti-Corruption Department.
(6) All Heads of the Department shall send a quarterly return in the enclosed proforma to the Deputy Inspector General of Police, Anti-Corruption Department in respect of the Departmental Enquiries on charges of corruption dealt with during the quarter so as to reach him by seventh of the month following.

Sub: Scrutiny of claims for Medical Reimbursement.
In this Department Order of even number dated 1-6-70 on the subject noted above, paragraph 2 required that medical reimbursement claims of a Government servant drawing pay less than Rs. 500/-p.m. should be subject to close scrutiny by the Countersigning Authority so as to ascertain genuineness of claims if the total amount involved in medical claims presented by an employee in any financial year comes to Rs. 1,000/- or more.
- In some quarters, a wrong impression seems to have been created that medical claims aggregating to less than Rs. 1,000/- in a financial year do not require scrutiny by the countersigning authority and such claims may be passed as a matter of course.
- It is hereby clarified that every claim for medical reimbursement irrespective of the amount involved is required to be scrutinised by the countersigning authority thoroughly and in case of any doubt regarding genuineness of the claim the countersigning authority may, if the circumstances of the case warrant, proceed to take action in the matter laid down in para 2 and 3 of the aforesaid order. In all cases where the total amount drawn by a Government servant on account of medical reimbursement in any financial year comes to Rs. 1,000/- or more, the countersigning authority shall invariably conduct carefully a special scrutiny of all past claims also in addition to the normal checks which he is required to exercise in his capacity as sanctioning authority before countersigning any medical claim.
- If any countersigning authority has passed medical claim without normal scrutiny, under a wrong impression as stated at paragraph 2 above, he should carry out a fresh scrutiny of all such claims.
- In the Register for Medical Reimbursement Claim Bills, the existing columns No. 11. 12 and 13 may be renumbered as 12, 13 and 14 respectively and a new column 11 for 'Progressive Total' may be inserted therein.

Sub: - Rajasthan Civil Services (Medical Attendance) Rules, 1970.
According to existing provisions under the Rajasthan Civil Services (Medical Attendance) Rules, 1970, reimbursement of expenditure on treatment at private consulting room or clinic of the Authorised Medical Attendant is not allowed. A question has been raised as to whether a Government servant as out-door patient can have treatment on the prescription of the Authorised Medical Attendant and whether such a prescription is essential to be got entered in the out door Patient Register of the Hospital/Dispensary.
The matter has been examined in consulting with Director of Medical and Health Services, Rajasthan, Jaipur, it has been decided that in case of a Government servant taking treatment as out-door patient it is not necessary to get the prescription of Authorised Medical Attendant entered into out-door patient register of the Hospital/Dispensary but in such a case Essentiality Certificate should be entered in Medical Reimbursement Register, maintained the Hospital/Dispensary of the Authorised Medical Attendant concerned.

Sub: - Scrutiny of claims for medical reimbursement.
A case has come to the notice of the Finance Department in which the countersigning authority in the course of scrutiny of medical reimbursement claims of the Government servant directed him for the medical check-up by an authority higher than the Authorised Medical Attendant. The countersigning authority also sent relevant papers relating to Medical claims i.e. vouchers/cash memos etc. to the medical authority. Subsequently these vouchers/cash memos relating to medical claim of the Government servant were lost either in the hospital or in transit and Finance Department was moved to accept the claims of the official concerned without production of vouchers etc. This situation could have been avoided if original vouchers/cash memos were not sent or only their copies sent, if it was necessary.
It is, therefore, enjoined on all authorities that in future while making scrutiny of claims for medical reimbursement the original vouchers etc. relating to medical claims of the Government servant should not be sent to any other quarter. If it is, however, considered necessary, only copies of the same should be sent for needful.

Sub: - Rajasthan Civil Services (Medical Attendance) Rules, 1970.
According to Rule 3 (2) (ii) (d) of Rajasthan Civil Services (Medical Attendance) Rules, 1970, charges paid by a Government servant for 'blood transfusion' are re-imbursable. A question has been raised as to whether the term 'Blood Transfusion Charges' referred to in the aforesaid rules includes the cost of blood purchased.
The matter has been examined and it is clarified that the term 'Blood Transfusion Charges' includes the cost of blood purchased by the Government servant locally and as such is reimbursable provided blood transfusion is at the hospital. Reimbursement of charges for blood transfusion at the residence of a Government servant will, however, not be ordinarily admissible and such cases of reimbursement for blood transfusion charges at the residence will be allowed only by Government on merit of the case.

Sub: Reimbursement of medical expenses incurred on medical treatment received abroad.
Government servants are allowed free medical attendance and treatment within the State in accordance with the provisions contained in the Rajasthan Civil Services (Medical Attendance) Rules, 1970. In accordance with these rules, if treatment not available in any Government hospital within the State the Director Medical & Health Services or the Principal of a Medical College can refer the ailing Government servant or a member of his family to any one of the recognized hospital outside the State where facility of the required treatment is available. Similar facility of free medical attendance and treatment is available to a Judge of the High Court, Members of the Legislative Assembly officers of the Legislative Assembly and Ministers. The aforesaid rules do not provide for reimbursement of medical expenses incurred on treatment received abroad.
- During the last few years some cases, mostly of by pass surgery, seeking permission for specialised treatment, outside India were received in the Finance Department. As the treatment for such ailments was not wide available in the country reimbursement of part of the expenses limited to actual hospital expenses only was agreed to in relaxation of the rules. In the cases of Judges of the High Court and public representative referred to in above para reimbursement of air fare, expenses on the medical attendant allowed to accompany and post operative expenses was also agreed in relaxation of the rules.
- The hospitals and clinics indicated in paragraph 6 below have developed facilities for specialised treatment for which requests are generally received for treatment abroad. Quite a few Government servants have received specialised treatment in these hospitals and clinics. The matter has therefore, been reconsidered and it has been decided that the following guidelines should be adopted in dealing with the cases relating to requests or medical treatment abroad and matters relating thereto :-
(i) As a rule, reimbursement of cost of medical treatment incurred abroad should not be allowed in any case.
(ii) The Director, Medical & Health Services and the Principals of the Medical Colleges have power under the relevant Medical Attendance Rules to refer the ailing Government servant or others entitled to free medical attendance to anyone of the recognised hospitals outside the State but within India, if the treatment is not available in any of the Government hospitals within the State. These rules do not provide that the Director/Principal may recommend for according permission to receive treatment abroad. Therefore, in case treatment is not available in any of the Government hospitals in the State, they may refer the Government servant to any of the recognised hospital outside the State but should not make recommendation for according permission for receiving treatment outside India.
(iii) Where the Government servants or others entitled to free medical attendance are referred to a recognised hospital outside the State for treatment in accordance with the provisions contained in the relevant rules and the recognised hospital advises specialised treatment in the same hospital but the concerned persons entitled to free medical attendance choose to go on their own for treatment abroad and request for reimbursement of cost of medical treatment incurred abroad, the Administrative department after obtaining concurrence of the Finance department may permit reimbursement which will be limited to the expenditure that would have been incurred had such treatment been received in the recognised hospital in India to which he had been referred for treatment, in relaxation of the rules.
- The following ailments have been identified by the Central Government vide their Office Memorandum No. S 14025/99/81 MS dated 6th December, 1982 as being such for which facilities for treatment in India are not yet widely established: and these have been accepted by the State Government also for adoption :-
(i) Cadaver kidney transplant;
(ii) Old operated bypass surgery cases (in which the initial operation was done abroad) needing revascularization:
(iii) Bone marrow transplant:
(iv) Operative correction for high myopia case;
(v) Complex cyanote Heart Lesion and newly born infants suffering from heart diseases.
- Reimbursement of actual hospital expenses only in connection with treatment received abroad of the ailments mentioned in para 4 may be permitted by the Administrative Department of the Government after obtaining prior concurrence of the Finance Department in relaxation of the rules provided the recognised referral hospital to which the ailing person was referred in accordance with the provisions contained in the relevant Medical Attendance Rules certifies that the treatment is not available in India and the certificate is endorsed by the Director, Medical & Health Services or the Principal of a Medical College. The question of reimbursement of travelling cost in such cases would not arise and all other expenses incidental to the treatment would also be borne by the Government servant himself.
- The following Institutions are among the Institutions identified by the Central Government as having facilities for specialised treatment. The State Government also recognises them as referral hospitals outside the State :
(a) Bypass coronary surgery :
(i) Christian Medical College & Hospital, Vallore.
(ii) K.E.M. Hospital, Bombay.
(iii) Jaslok Hospital, Bombay.
(iv) Bombay Hospital, Bombay.
(v) Appolo Hospital, Madras.
(b) Kidney Transplant:
(i) Christian Medical College & Hospital, Vallore.
(ii) All India Institute of Medical Sciences, New Delhi.
(iii) Post Graduate Institute, Chandigarh.
(iv) Jaslok Hospital, Bombay.
(c) Blood Cancer:
(i) Tata Memorial Hospital, Bombay.
(ii) Cancer Institute Adayar, Madras.
(d) Complicated heart surgery cases:
(i) Christian Medical College & Hospital, Vallore.

The State Government has recognised the "Escorts Heart Institute, New Delhi" as referral hospital for treatment of heart ailments of the Government servants outside the State and the name of this Institute is added below entry at S. No. (viii) under heading (d) Complicated heart surgery cases, at the last para of this department Office Memorandum No. F. 12(1) FD (Gr. 2)/89 dated 21 -2-89.

Sub: Rajasthan Civil Services (Medical Attendance) Rules, 1970.
Government servants were allowed facility of reimbursement in regard to Homeopathic treatment vide Finance Department Notification No. F. 12 (1) FD (Gr. 2)/85 dated 20-5-1985 and the same were extended upto 19-5-1990 vide this department order of even number dated 25-6-1987. The matter has again been considered by the Government and the Governor is pleased to order to extend the above facility upto 30-6-1953.
