No person is supposed to directly send a communication to a Judge [Read the Order]

While dealing with a case titled Dharam Pal Singh vs CBI on 17.03.2020, Supreme Court found that a managing director of hospital had sent compliance affidavit directly addressed to the judge. Then the Court recorded its unhappiness over such manner.

The Court noted "we had directed the jail authorities to take the petitioner in custody on his expense to the Yashoda Super Speciality Hospital, Ghaziabad. We had also directed the Managing Director of the said hospital to file an affidavit with regard to the nature of treatment required by the petitioner and whether the treatment is available in or around Dehradun. Instead of filing an affidavit in the Registry of this Court, the Managing Director has addressed a communication to one of us (Deepak Gupta, J.) along with Compliance Affidavit on behalf of Yashoda Super Speciality Hospital, Nehru Nagar, Ghaziabad. The same is placed on record".

Court then observed "We are not happy with the manner in which the Managing Director of the hospital has addressed a communication to one of the Judges comprising of the Bench which passed the earlier order. No party whether it is litigant or any other person is supposed to directly send a communication to a Judge".

Court then ordered "We, therefore, direct the Registry to return the said communication along with the compliance affidavit to the Managing Director of the hospital after retaining a copy of the same. The Managing Director is directed to file compliance affidavit in terms of our order dated 20.02.2020 in the Registry of this Court within two weeks from today".
