January,19,2017:

This is the Third Case in which he has managed to get acquitted.

Yesterday Actor Salman Khan was acquitted in yet another case under Arms Act.

This case was connected to other cases of poaching of an endangered species. He managed to secure acquittal because he had been booked under the wrong Section of the Arms Act law.

Salman had been charged under Sections 3/25 and 27 of the Arms Act for possessing and using firearms for which the licence had expired.

The local Trial court of the chief judicial magistrate, however, ruled that the licence was valid but needed renewal each year .

The Court gave a factual finding that the licence was valid for three years ie uptill August 8, 1999. It was valid even during the period in question.

The only allegation was just that it was not renewed (in 1998) for the next one year, as per the Judgement of acquittal.

Salman's Gun Licence was to be got renewed annually even while it was valid for three years under the Arms Act.

The CJM court ruled that Salman could have been prosecuted only under Section 21, and not Section 3 of Arms Act.

Salman Khan had been embroiled in other cases as well in the past. In one such case he was accused of killing a Blackbuck and a Chinkara in two separate incidents in September 1998.

The Sessions Court had convicted and sentenced him to one and five years in jail respectively for the two poaching cases. However Rajasthan High Court gave a huge relief to him as it acquitted him poaching cases of Jodhpur.

In yet another case it was alleged that on September 28, 2002, one Shaikh Noorulla Shafik was killed on the spot and four others were seriously injured when the 50-year-old actor’s Land Cruiser allegedly ran over him while the deceased was sleeping on the pavement.

In that case even though he was convicted by the trial court he managed to seek acquittal from the High Court of Bombay. It is widely believed that he is given benefit of doubt or benefit of technical flaw in the case each time. Appeal against acquittal is pending before Supreme Court.
