A bench of Justices Satyaranjan Dharmadhikari & Sandeep Shinde heard a PIL by activist Surinder Arora to register an FIR in the case.

The Bombay high court on Wednesday rapped the state for not registering a first information report in an embezzlement scam at Maharashtra State Cooperative Bank. NCP’s Ajit Pawar & Jayant Patil are among politicians who were directors accused of allegedly swindling the bank of thousands of crores.

A bench of Justices Satyaranjan Dharmadhikari & Sandeep Shinde heard a PIL by activist Surinder Arora to register an FIR in the case.

Nabard’s audit report had revealed breach of various banking laws & RBI guidelines by the directors who had distributed various loans to their sugar factories, spinning mills & other units between 2005 & 2010, & defaulted on repayment & recovery.

Prosecutor Deepak Thakare told the court the Economic Offence Wing DCP Shrikant Paropkari has said no offence is made out.

“Who is he to decide? What is he telling us... that we will not do anything?” asked Justice Dharmadhikari. He added, “Our query is not whether there is an offence. Have you registered an FIR?” The prosecutor replied in the negative.

Justice Dharmadhikari asked, “Why is it not registered? Be bold enough to say it.” The bench then reserved the order.
