June,14,2016:

MLAs were occupying office of profit  in violation of Constitution of India.

Delhi CM and AAP Supremo Arvind Kejriwal has suffered a major setback as President  Pranab Mukjerhjee has refused to give his assent to a Delhi Government's Bill aimed to ensure that the post of Parliamentary Secretary is excluded from the office of profit.

This decision of President has put a serious question mark over the fate of 21 MLAs Aam Aadmi Party, who are working as Parliamentary Secretaries in Kejriwal Government.

Disqualification of the these MLAs was sought in several Petitions on the ground that these MLAs are occupying office of profit which is in violation of Constitution of India.

President had referred the issue to the Election Commission which had in turn sought replies of the MLAs.

Delhi Government had on its part tried to diffuse the situation by amending the Delhi Members of Legislative Assembly (Removal of Disqualification) Act, 1997.

With this Bill, the Delhi  Government wanted to save the parliamentary secretaries from disqualification by “retrospectively” exempting them.

The Amendment Bill proposed by AAP Govt. was forwarded by Delhi Lt Governor Najeeb Jung to the Centre Govt.

GOI on its part added comments and sent it to the President.

However, the President refused to give his assent to the Bill.

21 AAP MLAs were appointed as Parliamentary Secretaries on March 13, 2015.
