In replies opposing the Narcotics Control Bureau (NCB) plea seeking cancellation of bail granted to TV comedian Bharti Singh and her scriptwriter-actor husband Haarsh Limbachiyaa in a drugs case, the defence said there is nothing on record to show that the magistrate was informed about inability of the special public prosecutor to attend court.

The defence said that a false allegation is being made against the court that despite informing bail was granted without hearing the prosecution. The defence plea submitted by advocate Ayaz Khan said the fact that court was operational only until 2.30 pm and the investigating officer reached at 3 pm showed that his efforts were false and bogus.

On November 23, the magistrate’s court granted the couple bail considering the facts that they were accused of being involved in a small quantity of drugs and the offence attracted up to one year in jail. NCB did not submit its reply to bail pleas or make submissions during the hearing.

The NCB, in its plea submitted in the special Narcotic Drugs and Psychotropic Substances Act court, said the magistrate’s bail order was “perverse, illegal and bad in law” and deserved to be set aside. The NCB’s plea will be heard on December 15.
