In a significant development, the Madras High Court has announced that it will hear the contempt of court case filed by renowned cricketer and former Indian captain, MS Dhoni, against Tamil Nadu cadre IPS officer Sampath Kumar. The hearing is scheduled to take place on Thursday, June 15.
During the proceedings, Justices M. Sundar and K. Govindarajan Thilakavadi informed senior counsel PR Raman, who represents Dhoni, and advocate Perumbalavil Radhakrishnan, the counsel for the IPS officer, about the hearing date. The judges explained that they dedicate Thursdays for the hearing of contempt of court petitions and therefore decided to schedule Dhoni's case on that day. It was also noted that Sampath Kumar had already submitted his reply affidavit to the contempt plea and was present in court during the latest hearing, despite his previous exemption from personal appearances.
Dhoni initiated legal action against Sampath Kumar by filing a petition seeking court intervention in response to the latter's derogatory remarks against the judiciary. These comments were included in Kumar's written statement, which was filed as part of Dhoni's Rs 100 crore defamation suit against the IPS officer. The defamation suit stemmed from Kumar's involvement in linking Dhoni's name to the IPL betting scandal.
To proceed with the contempt plea, Advocate General of Tamil Nadu, R. Shanmugasundaram, granted Dhoni the necessary permission under the Contempt of Courts Act. The Advocate General determined that Kumar's remarks in his written statement amounted to scandalizing court proceedings, which justified Dhoni's request for court action.
Notably, this legal battle originated in 2014 when Dhoni filed a Rs 100 crore defamation suit against Sampath Kumar, who held the position of Inspector General of Police (IG) at the time. The suit was filed due to Kumar's association of Dhoni's name with the match-fixing scandal during the IPL scam. Dhoni successfully obtained an interim injunction against both Kumar and a television channel involved in the matter.
In response to the defamation suit, Sampath Kumar alleged that it was filed as an attempt to silence him. However, Dhoni persisted in pursuing legal action against the IPS officer, leading to the present contempt of court case.
Dhoni's contempt plea centers on Sampath Kumar's disparaging remarks against the Supreme Court and the Madras High Court. Dhoni's aim is for the court to hold Kumar accountable for his comments, which violated a previous interim order issued in 2014.
Highlighting the seriousness of the matter, Dhoni stated, "He has stated that the Supreme Court deviated its focus on the rule of law and shelved the deposition of the Justice Mudgal Committee (constituted to probe 2013 match-fixing allegations) and kept it in a sealed cover for reasons he failed to comprehend."
With the hearing set for June 15, all eyes will be on the Madras High Court as it determines the course of action in this high-profile case that intertwines cricket, defamation, and allegations of contempt of court.
