The Madras high court while considering a writ appeal of an aggrieved lawyer puts hold on an unsigned order and gave ‘one more opportunity’ to the counsel to make her arguments.
The writ appeal was brought by a lawyer after the pronouncement of the judgment of the case where she was representing the respondent side. The lawyer alleged that the court had done ‘injustice’ after she got to know that the judgment had gone against the respondent. The lawyer mentioned that it was ‘unfortunate’ that the court had given the judgment without hearing her arguments and she was in the impression that the court would dismiss the case.
The bench of Justice N Kirubakaran and Justice B Pugalendhi expressed its dismay regarding the allegations of the lawyer and remarked “the outcry of the learned Counsel for the respondent amounts to contempt of Court and also needs a reference to the Bar Council of Tamil Nadu and Puducherry for taking disciplinary proceedings against her” however after considering the resentment of the lawyer, the court decided to give her one more opportunity to present her case and said “taking into consideration the fact that she is having a grievance, that she needs to be heard further in detail, this Court feels that since we have not signed the order yet, this Court will provide one more opportunity to the learned Counsel appearing for the respondent to put forth her further arguments in this matter.”
The court however did not take the appeal lightly commented “Whatever may be the proceedings or the result of the proceedings, a Senior Member of the Bar ought not to have stooped down to the level of making allegations against this Court” the court further expressed its concerns regarding such representation made by the counsel and added, “If this kind of attitude is going to be encouraged, it will send a wrong message to the Juniors, who are all watching the Court proceedings.”
