Saying that every person has a right to life, the state can't evict any landless person from a land even if he didn't have the title of the land, a division bench of HC observed & barred the Govt from removing residents of Sahava village in Churu district who inhabited a johar land.
The bench comprising Chief Justice Indrajit Mahanty & Justice Dinesh Mehta directed the Govt to verify the nature of encroachment as well as the land & make arrangements to allot land & a building in case of encroachers being landless for 3-6 months.
The Court gave these directions while hearing a plea by the residents of the village at Taranagar in Churu district settled on a johar land who challenged the eviction order by a single bench of the HC.
Moti Singh Rajpurohit, representing the petitioners, said over 300 houses had been built in the village a long time ago but few people approached the HC terming it to be encroachment demanding that encroachers be removed.
Rajpurohit said that “The single bench had given directions to identify those encroachments, demolish them & clear the land. These encroachers then challenged the order in the high court & prayed for alternative arrangements".
