In a significant ruling, the Madras High Court has acknowledged the valuable contributions of a homemaker and held that she is entitled to an equal share in the properties acquired by her husband in his own name.

Justice Krishnan Ramasamy, while delivering the judgment on June 21, emphasized the importance of recognizing the domestic chores performed by wives and their role in enabling their husbands to earn a living.

While India has yet to enact legislation to formally recognize the contributions of homemakers, the court expressed its willingness to acknowledge and honor these contributions. The judge stated that the court would consider the contribution made by wives in acquiring family assets through their domestic work, which releases their husbands for gainful employment.

The court emphasized that if the acquisition of assets is made through the joint contribution, directly or indirectly, of both spouses for the welfare of the family, both are entitled to an equal share. The judgment came in response to an appeal filed by Kamsala Ammal, who sought a share in the properties held by her deceased husband.

The case involved five properties, two of which were acquired by the husband using his earnings while working in Saudi Arabia. Another property was purchased in the wife's name, and some jewelry and sarees were kept in bank lockers under her possession. Ammal's claim for an equal share in these assets had initially been rejected by a local court in 2015.

However, the Madras High Court determined that despite the properties being acquired by the husband with his own savings, Ammal was entitled to a 50 percent share. The court also ruled that the contents of the bank lockers, which were purchased by the deceased as gifts for Ammal, solely belonged to her.

The court emphasized that the wife's contributions should not be ignored, as her efforts and sacrifices were crucial in enabling her husband to save money and acquire the properties. The judge noted that both the husband and wife are integral to the functioning of a family and should be treated as equal partners in their joint efforts for the welfare of the family.

While no specific legislation has been enacted to address this issue, the Madras High Court's ruling sets a precedent in recognizing the rights of homemakers and ensuring that their contributions are duly acknowledged and rewarded. The judgment aims to provide a fair and just outcome for homemakers who have dedicated their lives to caring for their families and supporting their spouses.
