A petitioner from Satna district has claimed that the district collector is threatening to get him booked if he raises the issue of encroachments on a pond in his village.
He further alleged that the district collector isn't acting against the encroachers under pressure from the local MLA.
Following a preliminary hearing on the plea, a division bench of Madhya Pradesh High Court comprising Chief Justice R V Malimath & Justice Purusendra Kaurav has issued notices to respondents in the case.
The petitioner, Gajan Singh, stated that a pond spread on an area of 11 acre in his village Gajan has been encroached upon by certain people. It's the only source of water for the people of the village.
It's not only essential for the lives of the residents of the village but also for the birds & animals. But, its existence is under threat due to encroachments.
In response to his earlier plea, the Court had asked the Public Land Protection Cell to take action in the matter.
Since the cell is not in existence in the Satna district, a contempt petition was filed in the High Court of Madhya Pradesh.
The lawyer for the petitioner KB Vishwakarma said that when the petitioner gave an application to the district collector seeking the removal of encroachments from the pond, he threatened to get him booked.
He is not acting under pressure from the local MLA, he said.
Following initial arguments, the Court issued notices to the respondents in the case.
The case will now come up for hearing on April 25.
