The Division Bench of the Delhi High Court in the case of Sanjeev Kumar vs Union of India & Ors. consisting of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad disposed off a plea challenging the clinical trial of Whole Virion Inactivated Coronavirus Vaccine on volunteers from the age group ranging between 2 to 18 years old.
Facts
A PIL was filed to quash and set aside the Impugned Order passed by the respondents for conducting phase II/III clinical trial of Whole Virion Inactivated Coronavirus Vaccine on healthy volunteers from the age group ranging between 2 to 18 years old while directing respondents to place on record the details of the 525 children who will be subjected to such trials. It also sought the criminal prosecution of those involved in such trials.
Observations of the Court
The Bench reiterated certain paras from a judgment relied upon by the Respondent (Union of India) titled Jacob Puliyel v. Union of India & Ors. wherein it was held that challenge to the procedures adopted by the expert bodies while granting regulatory approval to the vaccines on the ground of lack of transparency cannot be entertained.
Judgment
The Bench concluded that the Learned counsel for the parties were fair enough in stating before this Court that the controversy involved in the present matter stood concluded considering the aforesaid judgment and, therefore, no further orders were required to be passed in this case. The plea was disposed off accordingly.
