The Madras High Court has declined to grant anticipatory bail to N. Satish Kumar, the Namakkal District Secretary of the Tamilaga Vettri Kazhagam (TVK) party, in connection with incidents of violence that occurred on September twenty-seventh, allegedly involving party cadres.

Justice N. Senthilkumar, while dismissing the plea, observed that as the District Secretary, Kumar bore responsibility for maintaining discipline among party members and preventing any damage to public property during political activities.

Kumar had filed the anticipatory bail application, apprehending arrest under Sections 34 of the Tamil Nadu Public Property (Prevention of Damage and Loss) Act, 1992. According to the prosecution, during a TVK roadshow in Namakkal District, certain unidentified individuals entered the Dr. Lakshmanan Multi Speciality Hospital and caused damage to CCTV cameras, LED boards, and ceiling glass.

The applicant contended that he was being falsely implicated due to political rivalry and denied any wrongdoing. He argued that mere presence at the political campaign could not establish criminal liability and asserted that the allegations lacked substantive evidence.

Kumar further emphasized his willingness to cooperate with the investigation and stated that custodial interrogation was unnecessary, asserting that incarceration would serve no practical purpose.

Despite these submissions, the Court rejected the anticipatory bail plea, reinforcing that leadership positions in political organizations entail responsibility for the conduct of party members during public events.
