On Wednesday, the Supreme Court via its order issued has extended the limit of cases concerning to Arbitration Act and NI Act.
The Top Court has decided so in view of it’s earlier order passed in Suo Motu Writ Petition and taking into consideration the effect of the COVID 19 and resultant difficulties being faced by the Lawyers and Litigants.
The Court wanted to ensure that Lawyers/Litigants don't have to come physically to file such proceedings in respective Courts/Tribunal across the country.
Therefore, it ordered:
Added to above it mentioned that in case the limitation has expired after 15.03.2020 then the period from 15.03.2020 till the date on which the lockdown is lifted in the jurisdictional area where the dispute lies or where\ the cause of action arises shall be extended for a period of 15 days after the lifting of lockdown.
The order has been passed by Chief Justice SA Bobde, Justice Deepak Gupta and Justice Hrishikesh Roy on 06-05-2020.
