The Bar Council of India (BCI) has issued a Show Cause Notice to a law firm for alleged professional misconduct and violation of Rule 36 of the BCI Rules, citing its unauthorized video advertisement featuring Bollywood actor Rahul Bose. The BCI has directed the immediate removal of the advertisement from all digital platforms, stating that such promotional activities are in direct contravention of the ethical standards governing the legal profession.
The BCI, invoking its regulatory powers under the Advocates Act, 1961, has observed that the video promotes the law firm by portraying a misleading narrative, implying that clients should place blind faith in its services solely based on its 20 years of experience. The Council has reiterated that legal practice is not a commercial enterprise and that advertising legal services compromises the dignity, independence, and integrity of the profession. The Supreme Court has consistently upheld that advocacy is a noble profession and must be governed by trust, competence, and ethical standards, rather than commercial solicitation or promotional endorsements.
Referring to Rule 36, Chapter II, Part VI of the BCI Rules, the BCI has emphasized that advocates are prohibited from soliciting work or advertising through any form of media, directly or indirectly. The only permissible disclosure of an advocate’s credentials is through a website approved by the BCI, and any deviation from this constitutes professional misconduct, warranting disciplinary action under the Advocates Act, 1961. The BCI has also reiterated its position through press releases and judicial precedents, including the Madras High Court’s ruling, where the court categorically held that online promotional activities by law firms violate legal ethics and professional standards.
The firm has been directed to submit a written explanation within 10 days, justifying why disciplinary proceedings should not be initiated, and to provide an undertaking ensuring no further violations of Rule 36. Non-compliance with the directive will invite stringent disciplinary action, including suspension or cancellation of the firm's license to practice law.
