Mr. I.P. Kohli, learned counsel for the appellant/Insurance Company.
2. Present appeal has been filed against the judgment and award dated 12.11.2025 passed by the learned M.A.C.T./Additional District Judge, Tehri Garhwal in M.A.C.P. No. 20 of 2022, whereby compensation to the tune of ₹5,00,000/- has been awarded in favour of the respondents/claimants against the appellant/Insurance Company.
3. Learned counsel for the appellant/Insurance Company would submit that the impugned award is unsustainable in the eyes of law, inasmuch as there is no provision either under Section 166 or Section 164 of the Motor Vehicles Act, 1988 for awarding a lump sum amount of ₹5,00,000/- to the owner of the vehicle.
4. Issue notices to the respondents, returnable within four weeks.
5. Steps be taken within one week.
6. The execution of the impugned judgment and award dated 12.11.2025 shall remain stayed, subject to the condition that the appellant/Insurance Company shall deposit an amount of ₹2,00,000/- before the Tribunal concerned within a period of three weeks from today.
