2. By means of this writ petition, petitioner has sought the following relief:
"i) A writ, order or direction in the nature of the mandamus directing the respondents to give the minimum wages of Rs. 18000/- per month to the petitioner since her appointment in the department till present along with the arrears of the minimum wages due to the petitioner like the similarly situated Class-IV employees in the same department (i.e. District Food Supply Office) at Almora, are being paid."
3. According to the petitioner, her husband was engaged as a daily wager to discharge duties as Class-IV employee in the office of District Supply Officer, Bageshwar in the year 1992 and he served in that capacity till his death in 2013.
4. It is further her case that after the death of her husband she was engaged on compassionate ground as 'Peon' to serve against a Class-IV post w.e.f. 20.04.2018. However, her claim for minimum pay scale is not being considered even though she has served without any break in service.

5. Learned counsel for the petitioner relies upon a judgment rendered by coordinate Bench of this Court in WPSS No. 1589 of 2022. He submits that Mahendra Singh, who filed the said writ petition was also engaged as daily wager in the office of District Supply Officer, Bageshwar in 1992, therefore, similar order deserves to be passed in favour of petitioner also.
6. Learned State Counsel, however, submits that petitioner has not staked claim for regularisation and she has only prayed for grant of minimum of pay scale in this writ petition.
7. Having regard to the facts and circumstances of the case, the writ petition is disposed of with liberty to petitioner to make representation to the competent authority. It shall be open to the petitioner to stake claim of regularisation also. If she makes representation within three weeks from today, decision thereupon shall be taken, as per law, within four months thereafter.
8. Petitioner shall not be disengaged merely on the ground that she has approached this Court for seeking relief.
