Mr. Mani Kumar (through V.C.) and Mr. Saurabh Kumar Pandey, learned counsel for the petitioner.
2. Mr. G.S. Sandhu, learned A.A.G. and Mr. Deepak Bhardwaj, learned Brief Holder for the State.
3. By means of the present writ petition, the petitioner has sought to quash the impugned FIR bearing FIR No.21 of 2026, under Sections 323, 406, 420 & 504 of IPC, 1860, P.S. Gadarpur, District Udham Singh Nagar (Annexure No.1).
4. At the very outset, learned counsel for the petitioner would submit that the offences in the FIR punishable up to seven years and thus the case of the petitioner is covered by the judgment rendered by the Hon'ble Supreme Court in the case of Arnesh Kumar vs. State of Bihar and Another, (2014) 8 SCC 273.
5. On a query made to the learned Additional Advocate General, he does not deny the said position.
6. In such view of the matter, the writ petition is disposed of in terms of the case of Arnesh Kumar (supra).
7. All pending applications stand disposed of accordingly.
